Terms of Service
Please read these terms carefully before using Betterflag. By accessing or using the platform, APIs, SDKs, or MCP server, you agree to be bound by them.
Agreement to Terms
These Terms of Service ("Terms") are a legally binding agreement between you, whether personally or on behalf of an entity ("you", "your"), and Betterflag, operated by Mehdi Chioukh as a sole proprietorship registered in France (entrepreneur individuel, EI) ("Betterflag", "we", "us", "our"), concerning your access to and use of the Betterflag platform, website, dashboard, REST API, SDKs, MCP server, and any related services (collectively, the "Services").
By creating an account, starting a trial, or otherwise accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, do not use the Services.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, in which case "you" refers to that entity.
We may modify these Terms from time to time. We will notify you of material changes by updating the "Last updated" date on this page and, for changes that meaningfully affect your rights or your bill, by email at least 30 days before they take effect. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
The Services
Betterflag is a feature flag management platform. The Services let you create and manage feature flags, define targeting rules and percentage rollouts, manage environments and projects, and evaluate flags from your applications via our SDKs and edge-delivered evaluation API. The Services can be operated through the web dashboard, the REST API, and the Betterflag MCP server, which allows AI agents and developer tools to manage flags on your behalf.
The dashboard, API, and MCP server are different interfaces to the same account: actions taken through any of them are equally binding on you, are subject to these Terms, and are recorded in your account's audit trail.
Accounts and Registration
You must register for an account to use the Services. You agree to provide accurate, current, and complete registration information and to keep it up to date. You must be at least 16 years old and have the legal capacity to enter into these Terms.
You are responsible for safeguarding your account credentials, including passwords, API keys, SDK keys, and agent keys. Anything done through your account or with your keys is your responsibility. Notify us immediately at hi@betterflag.app if you suspect unauthorized use of your account or a compromised key; you can revoke and rotate keys at any time from the dashboard or API.
Subscriptions, Billing, and Metering
The Services are offered on paid subscription plans billed in advance on a recurring basis. Current plans, prices, included monthly flag evaluation volumes, and overage rates are published on our pricing page at betterflag.app/pricing, which forms part of these Terms. All plans include unlimited flags, seats, and environments; usage is metered on flag evaluations only.
Trial. New accounts receive a 14-day free trial on any plan, with no payment method required. If you do not subscribe by the end of the trial, your account is downgraded to a read-only state and flag evaluations stop being served; your configuration is retained so you can subscribe and resume later.
Overage. If your monthly flag evaluations exceed your plan's included volume, overage is charged at the per-million rate shown on the pricing page for your plan. Overage is metered usage: once evaluations have been served, the corresponding charges are owed. We surface usage in the dashboard and notify you as you approach your included volume.
Renewals and cancellation. Subscriptions renew automatically at the end of each billing period unless you cancel beforehand. You can cancel at any time from the dashboard; cancellation takes effect at the end of the current billing period, and you retain access until then. Refunds are handled under our Refund Policy.
Price changes. We may change plan prices or metering with at least 30 days' notice by email. Price changes never apply retroactively and take effect at your next renewal after the notice period. Discounts granted to you in writing (including the alpha waitlist lifetime discount) survive price changes as a percentage off the then-current price of your plan.
Taxes. Prices exclude applicable taxes (such as VAT or sales tax), which are added where we are required to collect them. Payments are processed by our third-party payment processor; we do not store your card details.
Agent and API Access
The Services are designed to be operated by AI agents and automated tooling through agent-scoped keys, the REST API, and the MCP server. You are fully responsible for all actions taken through your keys by any agent, script, or tool you connect, exactly as if you had taken them yourself. This includes flag changes, rollouts, kill-switch activations, and any resulting effects on your own applications and users.
We provide controls to help you supervise automated access, including agent-scoped keys with limited permissions, an agent-attributed audit trail, and configurable approval guardrails (for example, requiring human confirmation for production kill-switches on plans that support them). These controls are tools, not guarantees: configuring them appropriately for your risk tolerance is your responsibility.
You may not use agent or API access to circumvent plan limits, resell evaluation capacity, or interfere with the operation of the Services.
Acceptable Use
You agree not to:
- Use the Services for any illegal purpose or in violation of any applicable law or regulation.
- Probe, scan, or test the vulnerability of the Services, or circumvent, disable, or interfere with security-related features, rate limits, or metering.
- Attempt to gain unauthorized access to accounts, keys, or data belonging to other customers.
- Impose an unreasonable or disproportionate load on our infrastructure outside of normal flag evaluation traffic.
- Transmit viruses, malware, or other harmful code through the Services.
- Resell, sublicense, or white-label the Services without our prior written agreement.
- Misrepresent your identity or affiliation, or use another user's credentials.
- Reverse engineer, decompile, or disassemble the Services, except to the extent permitted by applicable law or by an open-source license under which a component (such as an SDK) is distributed.
We may suspend or restrict access, with notice where practicable, where we reasonably believe your use violates this section or threatens the security or integrity of the Services.
Your Data
"Your Data" means the data you submit to the Services, including flag configurations, targeting rules, environment and project settings, evaluation context attributes sent by your applications, and audit records generated by your account. You retain all rights to Your Data.
You grant us a limited, non-exclusive, royalty-free license to host, store, process, transmit, and display Your Data solely as necessary to provide, secure, and improve the Services. This license ends when you delete the relevant data or your account, subject to the backup retention periods described in our Privacy Policy.
Targeting and evaluation contexts should contain only the attributes needed for flag evaluation. Do not send us special categories of personal data (such as health, biometric, or financial account data) in evaluation contexts. Where evaluation contexts include personal data of your end users, you are the controller of that data and we process it on your behalf as described in our Privacy Policy.
You can export Your Data at any time through the dashboard or API, including before closing your account.
Intellectual Property
The Services, including all software, designs, text, and graphics (other than Your Data), and the Betterflag name and logo, are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes during your subscription, in accordance with these Terms.
Our SDKs and other client libraries may be distributed under their own open-source licenses; where they are, those licenses govern your use of that code.
If you send us feedback or suggestions, you grant us the right to use them without restriction or compensation.
Availability, Modifications, and Beta Features
We work to keep the Services highly available, including serving flag evaluations from a globally distributed edge network, but we do not guarantee uninterrupted access. We may perform maintenance, updates, or upgrades that temporarily affect availability, and will give reasonable advance notice of planned downtime where practicable. We recommend configuring SDK fallback values so your applications degrade gracefully.
We may add, change, or remove features of the Services. If we discontinue the Services entirely or remove a feature material to your use, we will give you at least 30 days' notice and the ability to export Your Data.
Features labeled alpha, beta, preview, or similar are provided as-is for evaluation, may change or be withdrawn at any time, and are excluded from any availability commitments.
Term and Termination
These Terms apply for as long as you use the Services. You may stop using the Services and close your account at any time from the dashboard or by emailing hi@betterflag.app.
We may suspend or terminate your access if you materially breach these Terms, if your account remains unpaid after notice, or where required by law. Except where immediate action is needed to protect the Services or other customers, we will give you notice and a reasonable opportunity to cure before terminating.
Upon termination, your right to use the Services ceases. You will have 30 days from the effective date of termination to export Your Data, after which it is deleted in accordance with our Privacy Policy, except where we terminated your account for a material breach involving abuse or fraud.
Disclaimers
Except as expressly stated in these Terms, the Services are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by applicable law.
Feature flags control the behavior of your own applications. You are responsible for testing flag configurations, staging rollouts appropriately, and supervising any agents you authorize to change them. We are not responsible for the behavior of your applications resulting from flag configurations you or your agents create.
Nothing in these Terms excludes or limits warranties or rights that consumers are entitled to under mandatory provisions of applicable law.
Limitation of Liability
To the fullest extent permitted by applicable law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or related to these Terms or the Services, even if advised of the possibility of such damages.
To the fullest extent permitted by applicable law, our total aggregate liability arising out of or related to these Terms or the Services will not exceed the greater of one hundred U.S. dollars (USD 100) or the amounts you paid us for the Services in the twelve (12) months preceding the event giving rise to the claim.
These limitations do not apply to liability that cannot be limited under applicable law, including liability for willful misconduct, gross negligence, or death or personal injury caused by negligence.
Indemnification
You will defend and indemnify us against third-party claims arising from Your Data, your applications, or your use of the Services in violation of these Terms or applicable law. We will defend and indemnify you against third-party claims alleging that the Services, as provided by us and used in accordance with these Terms, infringe that third party's intellectual property rights.
Governing Law and Disputes
These Terms are governed by French law, without regard to conflict of law rules. Betterflag is operated by Mehdi Chioukh, registered in France as a sole proprietorship (entrepreneur individuel, EI); the registered business address and registration details are available on request at hi@betterflag.app. Any dispute that cannot be resolved amicably will be brought before the competent French courts. Nothing in this section deprives you of the protection of mandatory consumer protection rules of the country where you reside, or of the right to bring proceedings there where applicable law grants it.
If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions remain in full force.
